General

  1. “Company” means Afri Skins Trading CC, “Customer” means the party who or which purchases the Products from the Company, and includes the Customer’s representatives, successors and permitted assigns. “Products” means the products of the Company which form the subject matter of this Contract, including but not limited to game skins, leather products and ancillaries.
  2. The customer agrees that (a) this contract represents the entire agreement between the customer and the Company and that no alterations or additions to this contract may be effected unless agreed to by both parties, reduced to writing and signed by both parties; (b) that this agreement will govern all future contractual relationships between the parties; and (c) is applicable to all existing debts between the parties.
  3. This document contains terms and conditions which appear in a similar style to this clause and which (a) may limit the risk of liability of the Company or a Third party, and or (b) may create risk or liability for the Customer and/or may compel the customer to indemnify the company or a third party and/or (d) serve as an acknowledgment by the customer of a fact. The customer’s attention is drawn to these terms and conditions because they are important and should be carefully noted. Nothing in this agreement is intended to or must be understood to unlawfully restrict, limit, or avoid any rights of the customer or the company.
  4. The Customer acknowledges that no representations were made of by the Company in regard to the product(s) or services or any of its qualities leading up to this contract and unless the Customer has specifically informed the Company of the intended use of the Product and the Company has specifically advised the Customer that the Product is suitable, the Company does not warrant that the Product(s) purchased by the Customer will be fit for the purpose that the Customer intends using the Products for;
  5. All products are sold with the understanding that the Customer has independently determined the suitability of such products for its purposes and that the Customer has tested the Product to determine the suitability of the Product for its intended purposes.
  6. In the event that the Company provides advice regarding the application of the Products at the request of the Customer, any possible liability of the Company in respect of the non-suitability of the Products for the purpose for which they are used will be limited to the selling price of those Products

 

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

 

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

 

The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

 

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

 

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

 

Product Information

All our animal products are 100% natural – not manufactured, tanned and graded by a world   award winning tannery and according to international standards. All sizes given are approximate, not exact.  The game skins and tannery services offered are 100% real and are beautiful commercial grade – not perfect “specimen” grade. Please keep in mind when ordering that no two items created by nature will be exactly alike. The coloring, sizing and sometimes the shape will vary. All items will have natural imperfections – blemishes, scars, etc. due to the environment in which they lived. None of the animal products that we sell has been bred in captivity and lived their natural lives in the wild where they are hunted by carnivore as prey, lived with natural infighting in the herds to adjust the pecking order of herds, in rugged terrain with thorny bushes and harsh desert environments. We will do our best to pick the best product per grade, as ordered, we have available.  We also offer handpicked and photographed items which allows you to see exactly what you are buying.

 

Ordering Requirements

This website or online or offline sales order system does not have a minimum order requirement.

All orders will be sent via website/email to Supplier. Supplier will accept each order by sending a confirmation email to customer latest within two (2) working days after receipt of order from Customer.

Once order has been received Supplier will apply for all outgoing permits (CITES and/or Export) in the name and delivery address of customer. It must be noted here that these permits are issued by the Ministry of Environment and Tourism of the Republic of Namibia and release of such permits can take between 7 to 14 working days. The ordering customer must apply for all import permits needed in the country/state of residence of customer and that these import permits must be forwarded to Supplier. All export and import permits must accompany Supplier documents to customer delivery address.

Supplier will forward the invoice (Excluding VAT for all export orders from Namibia) for the order with the invoice price, as per order, to the customer with the relevant banking details on the invoice to initialize payment by customer. The customer order will be confirmed as accepted once the customer payment appear on the bank statement of the Supplier. Such confirmation will be forwarded by email to the customer.

Once payment of order is confirmed, Supplier will send the invoice for the transport/courier to customer and Agent. It is noted here that the cost of transport/courier cannot be provided as a fixed cost as Game skins have different sizes and weights and such transport costs can only be obtained from the transport/courier company once a customer has been confirmed and paid for and the order has been packaged and weighed.

Once payment of transport/courier has been confirmed, Supplier will conduct a detailed and final quality check after completion of manufacturing, to ensure Customer’s quality criteria are fully met. Supplier will pack all orders as per international transport/courier standards, ensuring that each order package is clearly labelled with an address sticker and each package numbered, and as agreed with Agent & Customer and send the order directly to customer. The transport/courier waybill and tracking data will be emailed to customer. All documentation eg, copy of order, copy of invoice, copy of waybill, copy of import and export permits, relevant communication pertaining to each transaction, copy of transport/courier quote will be kept on file and/or archives for referencing or audit requests.

It is noted that the customer will be responsible for the import duties of the order as per the customs duties of the country/state of delivery.

In case of Customer’s quality criteria, are fully or partly not met (faulty goods), latest within 48 hours after receipt of manufactured goods Customer has to log an official complaint with Supplier by sending an email with detailed description of the production fault, accompanied with a photograph of the faulty goods, to Supplier. After both parties have established and agreed to products being faulty, Supplier will send a replacement for faulty goods latest within seven (7) working days as per Goods return policy. You will have to pay the return shipping cost and forward the returning waybill as proof for the return.    If you received the wrong item, we will, at our discretion, send you a return tag so you can send it back at our expense; and provided the item is received back in good condition, you will receive a full refund/replacement.

 

Shipping

All orders are shipped within three (3) days of final payment, not counting weekends or holidays. During extreme weather conditions (such as hurricanes, snow storms, floods, fires, mud slides, etc.) we cannot guarantee special shipping options. If you choose to request these shipping options, we will not be held responsible when items are not delivered on time.  Additionally, standard shipping may be delayed or unavailable in your area during extreme weather conditions.

 

We ship either TNT (Southern Africa) or FedEx (all areas outside of Southern Africa).

 

Environmental Policy

We follow all rules and regulations of the CITES agreement (Convention on International Trade in Endangered Species of Wild Fauna and Flora).  Also, the animal products we carry are by-products of the farming industry and government sanctioned and strictly regulated culling operations

 

Availability, Errors and Inaccuracies

We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.

 

We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

 

Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

 

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

 

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

 

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

 

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Afri Skins Trading CC and its licensors. The Service is protected by copyright, trademark, and other laws of both Namibia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Afri Skins Trading CC.

Our Service may contain links to third party web sites or services that are not owned or controlled by Afri Skins Trading CC (“us”, “we”, or “our”).

 

Afri Skins Trading CC (“us”, “we”, or “our”) has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Indemnification

You agree to defend, indemnify and hold harmless Afri Skins Trading CC, (“us”, “we”, or “our”) and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

 

Limitation of Liability

In no event shall  Afri Skins Trading CC(“us”, “we”, or “our”) nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Namibia, without regard to its conflict of law provisions.

 

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

 

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

 

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
